Disclaimer and Terms & Conditions
The customer is deemed to have agreed to the term and conditions/ disclaimer set out below by virtue of having entered into any written or oral agreement with the supplier for the supply of the services. Also, the customer agrees that he/ she/ it has read and understood the terms and conditions/ disclaimer and agrees to them.
General Terms & Conditions
The “Supplier” is Visas Zone, its employees, members, directors, agents, representatives, contractors and subcontractors.
The “Customer” is any natural or juristic person who enters into an oral or written agreement with the Supplier for the supply of the Supplier’s “Services” and any employees, members, directors, agents, contractors, sub-contractors, representatives and/or clients of the customer.
1. The “Services” provided by the Supplier are:
- Airport Services
- Biometrical Photographs
- International Assistance
- International & National Courier
- Visas
- Urgent & Same Day Visas
- Translations
- Other Documentation
2. the provision of the requirements of the relevant third party(ies) in respect of the completion and processing of the Service Documents; and
3. Submitting and collecting the Services Documents from the relevant third party(ies).
The services do not include:
- the processing and completion of any documentation whatsoever;
- the review of any such documentation at any stage in order to verify the accuracy, correctness or completeness of such documentation, including documentation delivered to or collected from the Customer or any third party;
Any advice provided to the Customer, or any information provided to the Customer by the Supplier in an advisory capacity, which is not a requirement of a third party in relation to the completion and processing of any Service Document, is at the Customer’s own risk and the Customer is required to verify all such advice with any relevant third party, as necessary.
The Supplier acts purely as a Visas Courier Service to and from Embassies, Consulates and High Commissions of those countries represented in South Africa. All decisions of whether or not to grant a visa to the Customer relies solely with the Embassy, Consulate or High Commission concerned.
Charges
All amounts payable for disbursements by the Service Provider on behalf of the customer shall be payable on the due date as stipulated on the invoice.
Any amounts due by customer for the Services rendered in terms of this Agreement shall be paid within seven (7) days (Accounts holders only) of receipt of a Tax Invoice. Upfront payment for the full taxable invoice amount is required for non-account holders.
In the event of payment due by customer to the Service Provider not being received on the due date, the Service Provider shall be entitled to suspend all services until such time that all outstanding payments reflect in the bank account.
Charges incurred due to the cancellation, amendment or transportation costs of any visa, or any other documentation submitted and collected as part of the Services, shall be for the Customer’s account. The Supplier shall not be obliged to obtain any visa, or any other documentation submitted or collected as part of the Services, on behalf of the Customer or any client of the Customer, where any cancellation, amendment or transportation costs are owing by the Customer to the Supplier and have not been paid. The Supplier is not obliged to deliver any travel documentation provided to it by the Customer, or any third party, until such time as all payments which have fallen due have been paid in full.
All fees payable in respect of the submission of any documentation, and all courier fees in relation to the submission of any documentation, including visas, to any third party whatsoever (for example, an embassy, high commission, consulate or government department) are non-refundable and shall be for the account of the Customer, irrespective of the outcome of the application for which the documentation is used.
Fees payable in respect of visa applications must be paid by the Customer to the Supplier in advance. Please note that all documentation submission fees, including fees in respect of visas, are subject to change without notice.
The Supplier will be entitled to charge an additional courier fee for emergency or late applications.
“Bank/ Processing fees” is the 3% disbursement fees paid to banks added onto the total invoice amount on the invoice that covers all bank related costs (i.e. credit card fees, clearance fees, immediate payments merchant, exchange rates etc);
“Disbursements” means all costs and fees that the Service Provider incurs or accrues on behalf of the customer in rendering the services as defined in this agreement. These costs and fees are those that the customer would have incurred irrespective if the services of the Service Provider were utilized or not (i.e. visa lodgement fees at the various embassies, bank charges/fees for any credit card transactions, foreign exchange rate fluctuations and discrepancies, software & member licenses etc.) An additional 3-5% disbursement/ Lodgement Fee may apply.
Disclaimer: Exclusion of Liability and Indemnity
The Supplier will not be liable for any direct or indirect loss, injury, death, damage, cost and/or expense sustained or incurred by the Customer, its employees, agents, contractors, sub-contractors, its clients and/or any third party which occurs as a result of the provision of the Services, including but not limited to any handling errors, theft, hijacking, loss or damage, inaccuracy, error, incompleteness, defect or deficiency in the documents submitted or collected in relation to the Services, or which occurs as a result of any action or omission of whatsoever nature on the part of the Supplier in the performance of the Services, whether caused by the negligence of the Supplier or otherwise, and the Customer indemnifies and holds the Supplier harmless against such loss, injury, death, damage, cost and/or expense.
The Supplier is entirely reliant on the relevant third party(ies) who provide the Supplier with the requirements for the successful completion and processing of the Service Documents and for the third party forms relating to the Service Documents. As such, the Supplier will not be liable for direct or indirect loss, injury, death, damage, cost and/or expense suffered or incurred by the Customer, its employees, agents, contractors, sub-contractors, its clients and/or any third party which occurs as a result of any change in such requirements or any change in third party forms as provided to the Supplier by a third party(ies), whether or not caused by the negligence of the third party(ies) or otherwise, and the Customer indemnifies and holds the Supplier harmless against such loss, injury, death, damage, cost and/or expense.
The disclaimer or exclusion of liability above does not exclude the liability of the Supplier where such liability is statutorily imposed upon the Supplier in terms of any South African legislation.
The liability of the Customer for any loss, injury, death, damage, cost and/or expense sustained or incurred by the Customer is limited to direct damages only, and excludes any liability for loss of revenue, business, contracts, anticipated savings, profits or commercial opportunities or in respect of any indirect or consequential losses whatsoever.”
Visa Denials:
We strive to provide the best possible service for all our clients. However, we cannot influence the decision of the Consulate or Embassy. We bear no responsibility or liability in the unfortunate event of a visa denial. Visa application fees are typically non-refundable, and they are at the discretion of the respective Consulate or Embassy.
Refunds:
If your visa application is denied, we will request a refund on your behalf. However, refunds are not guaranteed as they are subject to the policies and discretion of the respective Consulate or Embassy. You agree to understand that fees paid to Visas Zone for its services are separate and not always refundable.
Re-application:
Following a visa denial, you have the opportunity to re-apply for the visa. We can assist with the re-application process, but additional fees may apply.
No Guarantee of Outcome:
While we use our expertise and experience to give you the best chance of success, we cannot guarantee a positive outcome. The granting of a visa is not within our control and is at the sole discretion of the respective Consulate or Embassy.
Limitation of Liability:
We are not responsible for any actions, delays, or decisions by third parties, including Consulates and Embassies. We are not liable for any visa denials or delays, and we will not be liable for any loss, damage, delay, inconvenience, or direct or indirect loss you may suffer due to any denial or delay of visas from the Consulates or Embassies.
